Terms of Service

These Terms of Service govern access to the Warka website and use of the Warka HR platform. By using Warka, you agree to these terms.

Agreement

These Terms form a binding agreement between you and Warka. If you use Warka on behalf of an organization, you represent that you have authority to bind that organization.

If you do not agree, do not use the website or platform.

Our services

Warka provides a cloud-based HR platform including modules for people management, attendance, leave, recruitment, performance, payroll, tasks, and related features. Marketing content on our website describes the product but does not constitute a separate contract.

We may update, add, or remove features. We will use reasonable efforts to avoid material adverse changes to paid features during an active subscription term.

Accounts and eligibility

You must provide accurate registration information and keep credentials confidential. You are responsible for activity under your account.

Warka is intended for business use. You must be at least 18 years old and legally able to enter into contracts.

Plans, billing, and trials

Paid plans are billed per the pricing shown at signup or in your order, typically per employee per month or year. Taxes may apply.

Free tiers and trials may have usage limits (for example employee seat caps). We may change plan limits or pricing for new subscriptions with notice; changes to existing paid subscriptions apply at renewal unless otherwise stated.

Failure to pay may result in suspension or termination of access after notice where required.

Customer data and privacy

You retain ownership of data you submit to Warka. You grant Warka a limited license to host, process, and display that data solely to provide and improve the service.

You are responsible for having a lawful basis to collect and process employee and workforce data in Warka, including providing required notices to your personnel.

Our Privacy Policy describes how we handle personal information and is incorporated into these Terms by reference.

Acceptable use

You agree not to:

  • Use Warka for unlawful, harmful, or fraudulent purposes.
  • Upload malware or attempt to disrupt, probe, or gain unauthorized access to systems.
  • Reverse engineer or copy the service except where permitted by law.
  • Misuse another person’s data or infringe intellectual property or privacy rights.
  • Resell or sublicense the platform except as expressly allowed in writing.

Intellectual property

Warka and its licensors own the platform, software, branding, and documentation. These Terms do not grant you ownership of our intellectual property.

You may provide feedback; we may use it without restriction or compensation.

Confidentiality

Each party may receive confidential information from the other. The receiving party will protect it using reasonable care and use it only for purposes of the relationship, except as required by law.

Disclaimers

Warka is provided “as is” and “as available” to the maximum extent permitted by law. We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.

Warka supports HR workflows but does not provide legal, tax, or employment law advice. You are responsible for compliance with labor, payroll, and privacy laws applicable to your organization.

Limitation of liability

To the maximum extent permitted by law, Warka will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, data, or goodwill.

Our total liability for claims arising from or related to the service in any twelve-month period is limited to the fees you paid to Warka for the service in that period (or one hundred USD if you use a free tier).

Some jurisdictions do not allow certain limitations; in those cases, limits apply to the fullest extent permitted.

Indemnification

You will indemnify and hold Warka harmless from claims arising from your use of the service, your customer data, or your violation of these Terms or applicable law, except to the extent caused by our gross negligence or willful misconduct.

Suspension and termination

You may stop using Warka at any time. We may suspend or terminate access for material breach, non-payment, security risk, or legal requirement, with notice where reasonable.

Upon termination, your right to access the service ends. Provisions that by nature should survive (including payment obligations, confidentiality, disclaimers, and liability limits) will survive.

Governing law and disputes

These Terms are governed by the laws of the jurisdiction where Warka’s principal place of business is located, without regard to conflict-of-law rules.

Disputes will be resolved in the courts of that jurisdiction unless otherwise required by mandatory local consumer protection laws.

Changes to these terms

We may update these Terms from time to time. Continued use after the effective date of updated Terms constitutes acceptance. Material changes may be notified by email or in-product notice.
